If you are renting property in Wales then there are big changes coming your way !
In early 2022 the Welsh Government announced that the delayed Renting Homes (Wales) Act 2016 would be implemented in July 2022.
Tenants will receive significant additional protections under law with this Act, including:
- the end of tenancies and introduction of new 'occupation contracts'
- 6 month notice period for the replacement for section 21 notices
- no notice allowed in the first 6 months of occupation
- tenants/licensees have security of occupation for first 12 months
- stronger protection against retaliatory evictions
- mechanisms to remove individual tenants from a tenancy without ending the existing tenancy or add additional tenants
As of 22 July 2022 all new rental agreements must be in the new 'occupation contract' format, and all existing tenancies must by changed to occupation contracts within 6 months.
Changes are also under way to ensure greater safety for rental properties, including:
- all rental properties to have an Electrical Inspection Condition Report (bringing it in line with requirements in England), renewable every 5 years
- additional requirements for smoke detectors and carbon monoxide detectors in all rental properties
So buckle up, it is going to be an interesting 12 months or so in Wales in the rental sector. Keep an eye out for future blogs providing more information on some of these developments.
